These Terms of Service ("Terms") govern your access to and use of this website (the "Site"), operated by Exon 9 LLC ("Exon 9," "we," "us," or "our") under the commercial label Exon 9 Games. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not access or use the Site.

This Site is provided as an informational placeholder describing Exon 9 LLC's upcoming video game software and related digital publishing activities. Content on the Site is provided for general informational purposes only and is subject to change, including without notice.

All rights not expressly granted herein are reserved to Exon 9 LLC.

No license or right is granted to you to use, reproduce, distribute, modify, or create derivative works from any Content without the prior written consent of Exon 9 LLC, except as necessary to view the Site for personal, non-commercial purposes.

3. No Warranties

THE SITE AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EXON 9 LLC, ITS OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL EXON 9 LLC'S AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SITE EXCEED ONE HUNDRED U.S. DOLLARS (USD $100).

5. Indemnification

You agree to defend, indemnify, and hold harmless Exon 9 LLC and its officers, members, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Site or your violation of these Terms.

6. Third-Party Links and Storefronts

The Site may reference or link to third-party digital storefronts or platforms (including but not limited to Steamworks, the Apple App Store, Google Play, Epic Games, and itch.io). Exon 9 LLC does not control and is not responsible for the content, terms, or practices of any third-party site or platform, and your use of such platforms is governed by their respective terms and policies.

7. Modifications to the Site or Terms

We reserve the right to modify, suspend, or discontinue the Site, in whole or in part, at any time without notice. We may also revise these Terms from time to time. The revised Terms will be posted on this page with an updated "Last updated" date, and your continued use of the Site after such changes constitutes acceptance of the revised Terms.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in California.

9. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
